Parvez Elahi moves LHC against Punjab governor’s removal of him as CM

LAHORE: Parvez Elahi filed on Friday a petition in the Lahore High Court against his denotification from the post of chief minister by Punjab Governor Balighur Rehman.

Elahi, in his petition, has requested that the governor’s notification to denotify him as the CM be declared illegal.

The governor has been named as a respondent in the plea through the principal secretary and chief secretary. In the petition, it has been argued that the speaker was asked to call a session for a vote of confidence for the Punjab chief minister, but an assembly session was already in progress and, therefore, the speaker did not call a new session.

It is unconstitutional to denotify the CM and dissolve the cabinet over the speaker not summoning a session, the petition read. It added that no action can be taken against the CM on any initiative by the speaker.

Governor removes Parvez Elahi as Punjab CM

On Thursday night, Punjab Governor Baligh Ur Rehman denotified Chaudhry Parvez Elahi as the Punjab chief minister and dissolved the provincial cabinet, just days after Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan announced the dissolution of the Punjab and Khyber Pakhtunkhwa assemblies on December 23.

The governor had earlier asked the chief minister to take a vote of confidence on Wednesday at 4pm, which he did not.

The governor also tweeted the notification. The Punjab chief secretary, complying with the order of governor, later issued a notification that Elahi was no more the chief minister of the province.

A copy of it was also forwarded to the secretary to the president, secretary to the prime minister, Cabinet Division secretary, Election Commission of Pakistan secretary in Islamabad, the chief secretaries, governments of Sindh, Khyber Pakhtunkhwa, Balochistan, Gilgit-Baltistan and Azad Kashmir and other officials concerned.

PTI, PML-Q to move court against governor’s denotification of Elahi too

Following the Punjab governor’s late night notification, an emergency consultative meeting was called at Elahi’s residence, where Pakistan Mulsim League-Quaid (PML-Q) and Pakistan Tehreek-e-Insaf (PTI) mulled over their next move.

In consultation with PML-Q, its ally in the Punjab government, the PTI decided to move the court against the Punjab governor for denotifying Elahi as the province’s chief minister. 

Punjab Assembly Speaker Sibtain Khan, after the meeting, told journalists that the chief minister would move the court first thing in the morning and that the governor resorted to an “illegal” move.

Elahi had also rejected the governor’s act of de-notifying him and expressed his intention to challenge it in court.

“I reject the de-notification. I am the Chief Minister of Punjab and the cabinet will continue to function,” Elahi had said.

Elahi will take vote of confidence: Fawad

Per Geo News, PTI Senior Vice President Fawad Chaudhry rejected the notification and said that the governor had no authority to remove the chief minister.

The Constitution of Pakistan doesn’t acknowledge the governor’s notification, the PTI leader said. He added that the provincial assembly elects a chief minister and only it could remove him.

“The PML-N has revived the 58-2B,” he said.

Fawad noted the chief minister never said he wouldn’t take a vote of confidence — the one ordered by the governor. Elahi will take the vote of confidence only when the speaker convenes the assembly session, he explained.

A session of the provincial assembly will be held as usual today and Elahi will take the vote of confidence, the PTI leader said.

The PML-N should have completed its number in the assembly session, he said, adding there is no room for the governor’s notification in the Constitution.
